Welcome to Gofo Technologies. These Terms & Conditions govern your access to and use of our website and the services offered through it.

Gofo Technologies is an IT services provider based in Bengaluru, Karnataka, India. We provide technology solutions to individuals, businesses, startups and organisations.

Our services include:

By accessing our website, submitting an enquiry, placing an order or purchasing any service, you agree to comply with these Terms & Conditions.

1. Introduction

These Terms & Conditions apply to all visitors, customers and users of Gofo Technologies. If you do not agree with these terms, please do not use our website or purchase our services.

2. Service Orders and Confirmation

• Customers can browse, enquire about and purchase available services through our website.
• All service orders are subject to availability, technical feasibility and confirmation by Gofo Technologies.
• An order will be considered confirmed once the required payment is successfully received and the order is acknowledged by us.
• Customers must provide accurate and complete information while placing orders.
• We reserve the right to request additional information or clarification before initiating a service.
• Any additional requirements outside the agreed service scope may attract additional charges.

3. Pricing and Payments

• All service prices will be displayed on the website or communicated through an official quotation.
• Prices may vary depending on the service, technical requirements, service duration and third-party provider charges.
• Payments must be made through the payment methods made available by Gofo Technologies.
• Applicable taxes, including GST, will be charged as per prevailing Indian tax regulations.
• We reserve the right to revise service prices at any time. However, confirmed orders will be governed by the agreed pricing.
• Any additional work or service requested beyond the original quotation will be charged separately with customer approval.

4. Domain Registration and Renewal

• Domain registration is subject to availability and approval by the respective domain registrar.
• Domain names are registered through third-party domain registrars and are subject to their policies and terms.
• Domain registration does not guarantee permanent ownership. Customers receive registration rights for the applicable registration period.
• Customers are responsible for renewing their domains before the expiry date.
• Gofo Technologies may provide renewal reminders as a courtesy. However, we cannot guarantee successful delivery of reminders in every situation.
• Failure to renew a domain on time may result in suspension, expiry, redemption charges or permanent loss of the domain.
• Domain registration and renewal charges are generally non-refundable once successfully processed by the registrar, except where required by applicable law or expressly agreed otherwise.

5. Web Hosting Services

• Hosting services are provided according to the selected hosting plan and its specifications.
• Hosting resources, including storage, bandwidth, CPU, memory and other technical limits, depend on the purchased plan.
• Customers must not use hosting services for illegal activities, malware distribution, spam, phishing, unauthorised access or activities that violate applicable laws.
• We reserve the right to suspend or restrict hosting services if misuse, security threats or violations of these terms are identified.
• Server maintenance, hardware failures, network issues and third-party infrastructure problems may occasionally affect service availability.
• We will make reasonable efforts to maintain hosting availability but do not guarantee uninterrupted or error-free service.
• Customers are responsible for maintaining backups of their websites, databases, emails and other important data unless a specific backup service is included in their plan.
• Hosting renewal charges must be paid before the applicable expiry date to avoid interruption.

6. Business Email Services

• Business email services are provided based on the selected email hosting plan.
• Customers are responsible for maintaining secure passwords and protecting their email accounts.
• Customers must not use email services for spam, phishing, fraudulent communications or unlawful activities.
• Gofo Technologies is not responsible for email delivery failures caused by recipient servers, spam filters, DNS configuration, third-party email providers or external factors beyond our reasonable control.
• Customers are responsible for renewing email services before expiry.
• Email storage, account limits and other features depend on the purchased plan.

7. Website Design and Development

• Website design and development services will be delivered based on the scope, features and requirements agreed upon with the customer.
• Project timelines will be communicated before commencement of the project.
• Customers must provide the necessary content, images, logos, credentials and other materials required for project completion.
• Delays in providing content, approvals, feedback or required information may affect the project delivery schedule.
• Additional pages, features, integrations, design changes or functionality outside the agreed scope may attract additional charges.
• Customers must review and approve the website before final delivery or deployment.
• Website source code, design files and intellectual property ownership or usage rights will be governed by the agreed quotation or project agreement.
• Third-party themes, plugins, APIs, software and licensed resources remain subject to their respective licence terms.

8. Web Application Development

• Web application development projects will be undertaken according to the approved project proposal, specifications and milestones.
• Project costs and delivery timelines will depend on the complexity and functionality of the application.
• Any change in requirements after project approval may require a revised quotation and timeline.
• Customers are responsible for providing accurate business requirements and necessary data.
• Third-party integrations, APIs, payment gateways, SMS services and external platforms are subject to their respective terms, pricing and availability.
• Maintenance, upgrades, additional modules and technical support will be provided according to the selected agreement or service plan.
• Ownership and transfer of source code, credentials and project assets will be determined by the agreed project terms.

9. Refund and Cancellation Policy

• Customers may submit a refund request within 10 calendar days from the date of successful payment, but only for services explicitly identified as eligible for refunds.
• Refund eligibility depends on the specific service, its delivery status, work already completed and the terms communicated at the time of purchase.
• Services that have already been activated, registered, provisioned, completed or delivered may not qualify for a refund.
• Domain registration and renewal fees, third-party software licences, hosting activation charges, email service activation charges and other non-recoverable third-party expenses are generally non-refundable.
• Custom website development and web application development work already performed is not automatically eligible for a refund.
• Renewal payments and recurring service charges are generally non-refundable once the renewal or service period has commenced.
• Approved refunds will be processed through the original payment method or another mutually agreed payment method, subject to applicable payment processing requirements.
• Any applicable third-party charges or deductions will be communicated during the refund assessment.
• Refund requests must be submitted to [email protected] with the order details and reason for requesting the refund.
• We will review refund requests and communicate our decision within a reasonable period.

The 10-day refund window does not mean that every service purchased from Gofo Technologies is refundable. Only specifically eligible services qualify. Nothing in this policy limits any mandatory consumer rights or remedies available under applicable law.

10. Cancellation Policy

• Customers may request cancellation of an order before service activation or project commencement.
• Cancellation requests will be reviewed based on the status of the order and the work already performed.
• Any applicable refund will be determined according to our Refund and Cancellation Policy.
• Services already registered, activated, provisioned or delivered may not be eligible for cancellation or refund, subject to applicable law.
• Recurring services must be cancelled before their next renewal date to avoid further renewal charges.

11. Customer Responsibilities

Customers agree to:

• Provide accurate and complete registration and billing information.
• Maintain the confidentiality of their account credentials.
• Use our services only for lawful purposes.
• Avoid uploading or distributing malicious software, illegal content or unauthorised materials.
• Ensure that they own or have permission to use all content, images, trademarks and materials supplied to us.
• Make payments within the agreed timeframes.
• Cooperate with our technical team during service delivery and maintenance.

Customers will be responsible for any claims or damages arising from unlawful use of our services or materials supplied by them, to the extent permitted by applicable law.

12. Third-Party Services

Some of our services rely on third-party providers, including domain registrars, hosting infrastructure providers, email service providers, software vendors, payment gateways and API providers.

Their services are subject to their respective terms, conditions and privacy policies. Gofo Technologies is not responsible for third-party service interruptions, policy changes, pricing revisions or failures beyond our reasonable control.

13. Limitation of Liability

To the extent permitted by applicable law:

• Gofo Technologies shall not be liable for indirect, incidental, special or consequential losses arising from the use or inability to use our services.
• We shall not be responsible for data loss resulting from customer negligence, unauthorised access, third-party failures or circumstances beyond our reasonable control.
• We do not guarantee specific business results, website traffic, search engine rankings, revenue or application performance.
• Our liability for a particular service shall, to the extent legally permissible, be limited to the amount paid for that specific service giving rise to the claim.

Nothing in these terms excludes liability that cannot legally be excluded under applicable Indian law.

14. Suspension and Termination

Gofo Technologies reserves the right to suspend or terminate services in cases involving:

• Non-payment of invoices or renewal charges.
• Violation of these Terms & Conditions.
• Illegal or fraudulent activities.
• Security threats or misuse of infrastructure.
• Requests or directions from competent legal authorities.

Where reasonably possible, customers will be notified before suspension or termination, except where immediate action is necessary for security, legal or operational reasons.

15. Intellectual Property Rights

All original content, branding, graphics, website materials, logos and other intellectual property belonging to Gofo Technologies are protected under applicable intellectual property laws.

Customers may not copy, reproduce, distribute or commercially exploit our proprietary materials without prior written permission.

Ownership and usage rights for customer-specific deliverables will be determined by the relevant project quotation or agreement.

16. Changes to Terms

Gofo Technologies reserves the right to modify or update these Terms & Conditions at any time. Updated terms will be published on this website with a revised effective date. Continued use of our website or services after such updates will be subject to the revised terms, to the extent permitted by law.

17. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable consumer protection laws and other mandatory legal provisions, courts of competent jurisdiction in Bengaluru, Karnataka, shall have jurisdiction over disputes arising from these terms.
